We act both as a content contributor and as a hosting service—maintaining the infrastructure, organizational framework, and tools that allow our users to view, contribute, and edit content. Our endeavor is a balancing act between financing our operations and retaining our integrity.
The contents of our Site, including text, graphics, images, and other content, are for informational purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay in seeking it because of something you have read on our Site. Your use of our Site does not create a patient-physician relationship between You and SafeRecipes or any of its employees, visitors, or users. SafeRecipes is not intended to be a substitute for making sure products you buy or consume are safe. Products may be changed by manufacturers, and such changes may not be reflected on our Site. The information on our Site should not be considered current, complete, or exhaustive.

Because We provide a wide array of content that is produced or gathered by fellow users, you may encounter material that some may find offensive, erroneous, misleading, mislabeled, or otherwise objectionable.
Our site also generates some content like diet icons and nutritional values. While helpful to narrow down search results, this content may be inaccurate and may change overtime as we optimize the platform.
We ask that you use common sense and proper judgment when using our services, and acknowledge that you use our Site at your own risk. Please do not use SafeRecipes in any way to generate product labels. Refer to FDA Guidelines for accurate labeling.

SafeRecipes may permit users to submit text, images, media files, or other content ("User Content").
• Not transmit to Us material that is copyrighted, unless a) you are the sole copyright owner or b) have sufficient documented permission from all copyright owners;
• Not send material that reveals trade secrets, unless you own them or have sufficient documented permission from all owners;
• Not send material that infringes copyrights, trademarks, patents, or any other intellectual property rights of others or the privacy or publicity rights of others;
• Not send material that is subject to any current, anticipated, or threatened dispute, such as arbitration or litigation;
• Retain a copy of the User Content and agree that We shall not have any obligation to return the submitted copy and are under no obligation for any loss/damage to the submitted copy.
You are submitting User Content to Us voluntarily and without promise or inducement.
A "project" on SafeRecipes may be a recipe, a book, a resource, or a product. When you share a project, you permit users to view, print, or otherwise copy the project, and to share copies of the project in all media within any context presented by SafeRecipes, in all the universe, in perpetuity, provided they retain all attribution, copyright, and other proprietary notices contained in the Site Materials on any and all copies. You also permit users to share the link to the project. You understand that users may at times edit, adapt, or remix User Content, and give attribution for these adaptations at their discretion. If you share a project, then delete the project or change its Sharing to "Me", some users may still view or adapt some of the project's content. Content permissions are applied at the time of adaptation regardless of a project's Sharing status.
To edit means to modify, replace, or remove the existing content within a project. Users may never edit content that is copyrighted without permission.
When you permit users to edit your User Content within a project on SafeRecipes, you do so in all media within the context of SafeRecipes, in all the universe, in perpetuity.
When you edit User Content, you permit users to edit your resulting User Content within its original context on SafeRecipes. You understand that any permission conditions that apply to the content you are editing will also apply to your edited content. You may request attribution for your contributions.
You understand that once it has been edited, your User Content may not be retrievable. You allow users to remove or fully replace the User Content, including any attribution.
To adapt means to use content from one project in order to create a new project within the context of SafeRecipes (an "adaptation"). To remix means to edit content contained in an adaptation. Users may never adapt or remix content that is copyrighted without permission.
When you permit users to adapt or remix User Content, you do so in all media within the context of SafeRecipes, in all the universe, in perpetuity, provided the adaptation retains all attribution, copyright, and other proprietary notices contained in the original content. You allow users to share the adaptation on SafeRecipes. You understand that once you grant permission and an adaptation is created, you may not revoke the permission and you may not be able to remove the adaptation or its adaptations from SafeRecipes. Later edits to your content in the original project and permissions in the original project will not be retroactively added to existing adaptations, and will only be reflected in future adaptations of the original project.
You agree to adapt or remix User Content only within the context of SafeRecipes, only if the contributing user has granted permission, and provided you retain all attribution, copyright, and other proprietary notices contained in the original Site Materials on any adaptation you make of such material.
In the case where you are not the copyright holder of the User Content, you agree to share, permit editing, permit adapting, and/or permit remixing of User Content on SafeRecipes only with sufficient documented permission from the copyright holder. The permission must be granted at the time that the project containing the User Content is saved.
When users link to media from external websites, SafeRecipes can no longer vouch for the integrity of the content on those sites. For this reason, we limit allowable URLs to vetted sites. Linked media above a certain file size will not display in search results. SafeRecipes reserves the right to remove broken links.
At SafeRecipes, we respect the intellectual property rights of others. To protect these rights, we rely on users to notify us of potentially infringing content so that we can review it and take appropriate action, weather that’s leaving the content alone, taking it down, or even terminating the accounts of users who repeatedly post infringing content.
As detailed in the Digital Millennium Copyright Act (DMCA), users of SafeRecipes can submit takedown notices requesting the removal of content on the site if they believe their copyrights have been infringed. Once We receive a takedown notice, We will respond promptly and take whatever action we deem appropriate. If your content is removed due to a takedown notice We have received, you will be notified and will have an opportunity to file a counter-notice if you believe the content should not have been removed. More information on this process is below.
Filing a Takedown Notice
If you are the owner of copyrighted materials, or are authorized to act on their behalf, and you believe copyrighted content exists on SafeRecipes that violates the owner’s copyrights in the content, you may request the content be removed under the DMCA by submitting a takedown notice. All takedown notice must be submitted by the copyright owner or their authorized agent, such as a parent/guardian or an attorney. Your notice must contain the following information:

Filing a Counter Notice
While our main goal is to protect the copyrights of our users and other individuals, We recognize that not every takedown notice is accurate or valid. If you believe your content was removed due to a mistake or misidentification, We encourage you to file a counter-notification. Your counter-notice mustcontain the following information:

When contributing content, please act in good faith, be civil and polite, and make contributions aimed at furthering the SafeRecipes mission. The following activities violate our rules and may also subject you to liability. We reserve the right to exercise our enforcement discretion with respect to these rules.

• Do not provide professional advice about medical, health, legal, tax, financial, or investment issues;
• Do not contribute or send material that is obscene, defamatory, threatening, dangerous, harassing, abusive, or hateful;
• Do not vandalize other users' contributions;
• Do not contribute or send sexually-explicit images;
• Do not contribute or send advertisements or solicitations of business;
• Do not contribute or send chain letters or pyramid schemes;
• Do not misrepresent your affiliation with any individual or entity;
• If you receive or expect to receive compensation for contributions, you must include attribution with your User Content, in the form of a link to your user page, and you must disclose the paying party or parties on your user page and share your user page publicly;
• Do not impersonate another person;
• Do not violate the privacy of others;
• Do not solicit any personally identifiable information for any purpose;
• Please do not provide any personally identifiable information (including name, address, phone number, social security number);
• Do not engage in fraud;
• Do not contribute content that contains viruses, malware, worms, Trojan horses, malicious code, or other device that could harm our technical infrastructure or system or that of our users;
• Do not Engage in automated uses of our Site that are abusive or disruptive of the services and have not been approved by SafeRecipes;
• Do not disrupt the services by placing an undue burden on the networks or servers connected with our Site;
• Do not knowingly access, tamper with, or use any of our non-public areas in our computer systems without authorization;
• Do not probe, scan, or test the vulnerability of any of our technical systems or networks.
If you create an account on our Site, you agree to accept sole responsibility for all activities that occur under your account, whether or not you have authorized the activity. You agree you will not sell, transfer, or assign your account or any account rights. You agree to notify Us immediately at privacy@saferecipes.com of any breach of security or unauthorized use of your account.
You can stop using our services at any time. In certain circumstances, it may be necessary for Us to terminate part or all of our services, terminate these Terms, block your account or access, or ban you as a user. SafeRecipes reserves the right to suspend or end the services at any time, with or without cause, and with or without notice, and to remove any User Content from our Site for any reason.
While users of our Site are bound by these Terms not to submit false or harmful material, SafeRecipes cannot be responsible for the violation of these Terms by users, or for the reliance by users upon false or misleading material submitted by other users.
If your activity or any activity on your behalf creates potential or actual liability for Us, or for any of our users, partners, or contributors, you agree to indemnify and hold Us and any such user, partner, contributor, or any agent harmless from and against all claims, costs (including legal fees), liabilities, obligations, damages, and losses, in relation to any claims or actions arising out of or relating to your use of our Site, inability to access our Site, or any breach by you of these Terms. SafeRecipes reserves the right to assume or participate, at your expense, in the investigation, settlement and defense of any such claim or actions. Our liability will be limited to the fullest extent permitted by applicable law. This indemnity includes without limitation any claims that your User Content violate or infringe any copyright, patent, privacy right, publicity right, trademark, service mark, or any other personal property right of any person or entity, or that the User Content constitute or include defamation of any person or entity.
SafeRecipes does not claim that access to our Site is legal for all individuals in all countries. If you access our Site illegally, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
Our Site and Site Materials are provided on an "as is" basis without any warranties of any kind. Reliance on any information provided by SafeRecipes, SafeRecipes employees, others appearing on our Site at the invitation of SafeRecipes, or other visitors to our Site is solely at your own risk.
We make no warranty that our services will meet your requirements, be safe, secure, uninterrupted, timely, accurate, error-free, or that our Site and its server are free of computer viruses or other harmful material. Any material visited, downloaded or otherwise obtained through your use of our services is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the visit or download of any such material. You agree that We have no responsibility or liability for the deletion of, or the failure to store or to transmit, any content or communication maintained by the service.
You release, acquit and forever discharge Us of and from any and all claims, debts, dues, accounts, demands, actions, causes of action, suits, proceedings, costs, expenses, liabilities, obligations and compensation of any kind whatsoever, in law or in equity, whether known or unknown, anticipated or unanticipated, accrued or hereafter to accrue, under any theory of law, which You have or may have against Us arising from Our (or Our lack of) receipt, possession, use and/or disposal of your User Content now or in the future.
If your use of our Site or our Site Materials results in any costs or expenses, including, without limitation, the need for servicing or replacing equipment or data, SafeRecipes shall not be responsible for those costs or expenses.
We retain the right to create limits on use and storage at our sole discretion at any time with or without notice. We reserve the right to add, change, and remove features, content, and data, including the right to add or change any pricing terms. You agree that We will not be liable for any such changes.
These Terms are governed by the substantive laws and courts of the Commonwealth of Massachusetts without respect to its conflict of laws principles.
If any provision is found to be unlawful or void by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
You agree to submit to the personal jurisdiction of, and agree that venue is proper in, the courts located in Boston, MA, in any legal action or proceeding relating to Us or these Terms.
If in any circumstance, We do not apply or enforce any provision of these Terms, it is not a waiver of that provision.
These Terms were written in English (U.S.). While We hope that translations of these Terms are accurate, in the event of any differences in meaning between the original English version and a translation, the original English version takes precedence.
If you have not signed a separate agreement with Us, these Terms and our Privacy Policy constitute the entire agreement between you and SafeRecipes with respect to the use of our Site and Site Materials. If there is any conflict between these Terms and a signed written agreement between you and Us, the signed agreement will prevail.
